These General Terms and Conditions (hereinafter referred to as the "GTC") govern the use of the kefirgomba.eu online store (hereinafter referred to as the "Webshop"), operated by Tibor Farkas, Sole Proprietor (hereinafter referred to as the "Seller").
Purchases in the Webshop may be made by placing an electronic order in accordance with these GTC. By submitting an order, the Customer acknowledges that they have read, understood, and accepted these GTC.
The Webshop primarily offers Tibetan Kefir Grains (milk kefir culture) and accessories related to the preparation of homemade milk kefir. As the products may contain natural live microorganisms, they require proper storage and handling.
All information published on the Website is provided for informational purposes only and does not constitute medical, healthcare, nutritional, or professional advice.

Tibor Farkas, Sole Proprietor, the operator of the kefirgomba.eu Webshop and the seller of the products offered therein.
Consumer:
A natural person acting outside the scope of their trade, business, profession, or independent occupation.
Customer:
Any natural person or legal entity that places an order through the Webshop.
All prices displayed in the Webshop are stated in Hungarian Forints (HUF).
The Seller operates under the Hungarian VAT exemption scheme (VAT-exempt sole proprietor); therefore, the prices displayed in the Webshop do not include Value Added Tax (VAT).
The Seller reserves the right to modify prices without prior notice. Any price changes shall not affect orders that have already been confirmed.
Due to the natural characteristics of live cultures, slight variations in appearance, size, shape, or biological activity may occur. Such variations are considered normal and do not constitute a product defect.

The sales contract is concluded upon the Seller's confirmation of the order by e-mail.
The confirmation e-mail contains the details of the order, the purchase price, and the applicable shipping costs.

Payments in the Webshop are processed through the secure online payment system provided by Barion Payment Zrt. The following payment methods are accepted:
Online card payments are processed exclusively through the Barion payment system. The Seller does not have access to, nor does it store, the Customer's bank card details. Barion Payment Zrt. is a financial institution supervised by the National Bank of Hungary (Magyar Nemzeti Bank) under licence number H-EN-I-1064/2013.
At present, products are delivered within Hungary only. The following delivery options are available:
The applicable shipping costs are displayed during the checkout process before the order is finalised. Orders are normally dispatched within 1-2 business days after successful payment has been received.
While the Seller makes every reasonable effort to ensure timely delivery, the Seller shall not be liable for delays caused by the courier service or by circumstances beyond the Seller's reasonable control. Nevertheless, the Seller will provide all reasonable assistance in resolving any delivery-related issues.
The Customer is requested to inspect the parcel immediately upon delivery. If the package shows visible signs of damage, the Customer should request that the courier prepares a damage report before accepting the shipment.
Tibetan Kefir Grains and other live fermentation cultures supplied by the Seller contain living microorganisms. To maintain the quality and viability of the products, the Customer must carefully follow all storage, handling, and preparation instructions published on the Website and included with the delivered product.

As Tibetan Kefir Grains are living cultures, natural variations in growth, appearance, and fermentation activity may occur. Such variations are considered normal characteristics of the product and shall not be regarded as defects.
Pursuant to Hungarian Government Decree No. 45/2014 (II.26.), Consumers are generally entitled to withdraw from the contract within 14 days without giving any reason. However, the applicable legislation also specifies certain cases in which the right of withdrawal does not apply. These exceptions are set out in Section 10 of these General Terms and Conditions.
To exercise the right of withdrawal, the following conditions apply:
The Consumer is responsible only for any diminished value of the product resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the product.
The Consumer may exercise the right of withdrawal not only by e-mail but also by completing the Online Withdrawal Form available in the Webshop.
After successful submission of the online withdrawal form, the system automatically sends an electronic confirmation to the e-mail address provided by the Consumer. This confirmation serves as proof that the withdrawal notice has been received and records the date and time of submission on a durable medium (e-mail).
In accordance with Section 29 of Hungarian Government Decree No. 45/2014 (II.26.), the right of withdrawal does not apply, among others, to:
Due to the sensitive nature of live fermentation cultures, the Seller is entitled to examine the condition of any returned product and to determine whether the statutory right of withdrawal applies to the specific circumstances of the return.
The live fermentation cultures supplied by the Seller, including Tibetan Kefir Grains, contain living microorganisms. For this reason, every withdrawal request is assessed individually in accordance with the applicable legislation, taking into account:
Nothing in this Section limits or excludes any mandatory consumer rights granted under applicable Hungarian or European Union law.
The Seller shall be liable for statutory warranty claims (implied warranty) in accordance with the applicable provisions of the Hungarian Civil Code.
If the product is defective at the time of delivery, the Consumer may exercise the statutory warranty rights provided under applicable Hungarian law. The Consumer may, subject to the conditions laid down by law, request:
The Consumer must notify the Seller of any defect without undue delay after becoming aware of it. Nothing in this Section limits any mandatory statutory rights granted to Consumers under Hungarian or European Union law.
The information published on the Website regarding Tibetan Kefir Grains, homemade milk kefir, fermentation, nutrition, or general well-being is provided solely for informational and educational purposes.
The products offered by the Seller are not medicinal products, medical devices, or dietary supplements, and no statement published on the Website shall be interpreted as medical advice, diagnosis, treatment, or a guarantee of any specific health outcome.
The Customer is solely responsible for the preparation, storage, handling, and consumption of homemade milk kefir produced using the purchased live cultures.

The Seller will investigate every complaint fairly and in good faith and will make reasonable efforts to provide a response as soon as possible. The Seller aims to respond to written complaints within 30 calendar days, unless a shorter period is required by applicable law.
If a dispute cannot be resolved amicably, the Consumer may seek assistance from the competent Hungarian consumer protection authorities or other dispute resolution bodies available under applicable law:
All content published on the Website, including but not limited to text, photographs, graphics, logos, product descriptions, documents, downloadable materials, and the overall design and layout of the Website, is protected by copyright and other intellectual property laws. Unless otherwise stated, all intellectual property rights are owned by the Seller.
No content from the Website may be copied, reproduced, distributed, published, translated, modified, or used for commercial purposes without the Seller's prior written permission. The Customer may use the Website and its content solely for personal, non-commercial purposes.
These General Terms and Conditions shall be governed by and construed in accordance with the laws of Hungary.
Any matters not expressly regulated by these General Terms and Conditions shall be governed by the applicable provisions of Hungarian law, including the Hungarian Civil Code and the relevant consumer protection legislation.
If any provision of these General Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
The Seller reserves the right to amend these General Terms and Conditions at any time. Any amendments shall become effective upon publication on the Website and shall not affect contracts concluded prior to their effective date.
